Adaptation of the model statute to new legal regulations

In 2024, far-reaching political changes with impacts on cooperatives were initiated. Since the beginning of 2025, key business processes – including establishment, membership, transfers, and authorisations – can be conducted not only in written form but also in text form. A handwritten signature is required for the written form, whereas a simple, unsigned document is sufficient for the text form. Further amendments to the Cooperative Societies Act (GenG) are currently under political discussion.  

Against this backdrop, it makes sense in the medium term to modernise the statutes of Prokon Regenerative Energien eG and adapt them to the new legal requirements. However, the cooperative auditing association of Prokon eG, Genoverband e. V., recommends first waiting for the reviewed amendment recommendations from the Legal Committee (FAR) of the German Cooperative and Raiffeisen Association (DGRV). This ensures a legally compliant and comprehensive implementation of the statutory changes in a single step.  

As it is currently unclear when the FAR will publish its recommendations, the Executive Board of Prokon eG will first wait for the new model statutes before proposing statutory amendments for the 2026 General Assembly based on them. We will keep our members informed about further developments.
